Bu aydınlatma metni, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun ("Kanun") 10. maddesi ve Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ uyarınca, cpmistanbul.com internet sitesini ziyaret eden ve sitedeki iletişim formu aracılığıyla bize ulaşan kişileri bilgilendirmek amacıyla hazırlanmıştır.

Hangi kişisel verilerinizi işliyoruz
cpmistanbul.com bir portfolyo sitesidir. Sitede üyelik, satış veya reklam yoktur. Kişisel veriler üç durumda işlenir: iletişim formunu gönderdiğinizde, siteye bağlandığınızda sunucunun tuttuğu teknik kayıtlarda ve ziyaret istatistikleri oluşturulurken.

İşleme amaçları ve hukuki sebepler
Kişisel verilerinizi aşağıdaki amaçlarla ve Kanun'un 5. maddesinin 2. fıkrasında sayılan hukuki sebeplere dayanarak işliyoruz. Bu işlemlerin her biri için Kanun'da öngörülen bir hukuki sebep bulunduğundan açık rızanıza başvurmuyoruz.

Kişisel verilerin toplanma yöntemi
Kişisel verileriniz elektronik ortamda ve otomatik yollarla toplanır. İletişim formuna yazdığınız bilgiler formu gönderdiğinizde bize ulaşır; işlem güvenliği verileri ise siteye her bağlandığınızda sunucu tarafından kaydedilir. İstenmeyen gönderileri önlemek için sunucu, IP adresinizi kısa bir süre yalnızca çalışma belleğinde tutar; bu bilgi kalıcı olarak kaydedilmez. Sunucu kayıtlarına IP adresinizin tamamı yazılmaz, yalnızca kısaltılmış hali kaydedilir. Ziyaret istatistikleri, bir sayfayı açtığınızda sitedeki bir betik aracılığıyla otomatik olarak toplanır; çerez kullanılmaz ve IP adresiniz saklanmaz.
Kişisel verilerin kimlere ve hangi amaçla aktarıldığı
Kişisel verilerinizi satmıyor, reklam amacıyla kimseyle paylaşmıyoruz. Verileriniz Kanun'un 8. ve 9. maddelerine uygun olarak yalnızca aşağıdaki alıcılara ve belirtilen amaçla sınırlı olarak aktarılır:
- Barındırma hizmeti sağlayıcısı: Sitenin çalıştığı sunucuyu işleten Hetzner Online GmbH (Almanya). Sunucu kayıtları, ziyaret istatistikleri ve form gönderileri bu sunucuda işlenir. Hetzner, verileri bizim adımıza ve talimatlarımız doğrultusunda işleyen veri işleyendir.
- E-posta hizmet sağlayıcısı: Form gönderileri, kurumsal e-posta hizmetimiz Google Workspace aracılığıyla info@cpmistanbul.com adresine iletilir ve bu hizmette saklanır. Google, verileri bizim adımıza ve talimatlarımız doğrultusunda işleyen veri işleyendir. Veriler, ABD başta olmak üzere Google'ın farklı ülkelerdeki veri merkezlerinde işlenebilir.
- Yetkili kamu kurum ve kuruluşları: Mahkemeler, savcılıklar ve kanunen bilgi istemeye yetkili diğer kurumlar; yalnızca hukuken zorunlu olduğu hallerde ve istenen bilgiyle sınırlı olarak.
Ana sayfadaki proje videolarından birini oynattığınızda video, youtube-nocookie.com üzerinden YouTube'dan yüklenir. Bu andan itibaren Google, kendi gizlilik politikası kapsamında ve kendi sorumluluğunda veri işleyebilir; bu verilere biz erişmeyiz. Ayrıntılar Gizlilik ve Çerez Politikası'nda yer alır.
Yurt dışına aktarım
Sitemizi barındıran sunucu Almanya'da bulunduğundan, siteye bağlandığınızda ve formu gönderdiğinizde kişisel verileriniz yurt dışında işlenir. E-posta hizmet sağlayıcımız Google da yurt dışında yerleşik olduğundan, form gönderileri bu hizmet aracılığıyla da yurt dışına aktarılır.
Saklama süreleri
- İletişim formu gönderileri: Talebinizi yanıtlamak ve olası bir iş birliğini değerlendirmek için gerektiği sürece e-posta kutumuzda saklanır. Bir iş ilişkisine dönüşmeyen yazışmalar düzenli olarak gözden geçirilir ve artık gerekmediğinde silinir. Talebiniz bir iş ilişkisine dönüşürse ilgili yazışmalar, Türk Ticaret Kanunu ve vergi mevzuatında öngörülen süreler boyunca saklanır.
- E-postayla iletilemeyen gönderiler: Teknik bir sorun nedeniyle e-posta gönderilemezse, mesajınız kaybolmasın diye gönderinin bir kopyası sunucuda en fazla 30 gün tutulur ve bu sürenin sonunda otomatik olarak silinir.
- Ziyaret istatistikleri: 2 yıl sonra otomatik olarak silinir.
- Sunucu kayıtları: 30 gün sonra otomatik olarak silinir. Kayıtlarda IP adresinizin tamamı değil, yalnızca kısaltılmış hali yer alır.
- İstenmeyen gönderileri önlemek için tutulan IP bilgisi: Yalnızca çalışma belleğinde ve kısa bir süre; kalıcı olarak kaydedilmez.
Saklama süresi dolan veya işlenme sebebi ortadan kalkan kişisel veriler, Kişisel Verilerin Silinmesi, Yok Edilmesi veya Anonim Hale Getirilmesi Hakkında Yönetmelik uyarınca silinir, yok edilir ya da anonim hale getirilir.
Kanun kapsamındaki haklarınız
Kanun'un 11. maddesi uyarınca CPMistanbul'a başvurarak:
- kişisel verilerinizin işlenip işlenmediğini öğrenme,
- işlenmişse buna ilişkin bilgi talep etme,
- işlenme amacını ve verilerin amacına uygun kullanılıp kullanılmadığını öğrenme,
- yurt içinde veya yurt dışında verilerinizin aktarıldığı üçüncü kişileri bilme,
- eksik veya yanlış işlenmişse düzeltilmesini isteme,
- Kanun'un 7. maddesindeki şartlar çerçevesinde silinmesini veya yok edilmesini isteme,
- düzeltme, silme veya yok etme işlemlerinin verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
- işlenen verilerin münhasıran otomatik sistemler aracılığıyla analiz edilmesi sonucunda aleyhinize bir sonuç çıkmasına itiraz etme,
- verilerinizin kanuna aykırı olarak işlenmesi nedeniyle zarara uğramanız halinde zararın giderilmesini talep etme
haklarına sahipsiniz.
Başvuru yöntemi
Bu haklara ilişkin taleplerinizi, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ uyarınca aşağıdaki yollardan biriyle iletebilirsiniz:
- Islak imzalı bir dilekçeyle, Cumhuriyet Mah. Kazım Orbay Cad. C Blok No:3/11, Şişli / İstanbul adresine bizzat teslim ederek, iadeli taahhütlü posta veya noter aracılığıyla göndererek,
- Güvenli elektronik imza veya mobil imza ile imzalayarak info@cpmistanbul.com adresine,
- Daha önce bize bildirdiğiniz ve sistemimizde kayıtlı olan e-posta adresinizden info@cpmistanbul.com adresine.
Başvurunuzda şu bilgilerin bulunması zorunludur: adınız ve soyadınız, başvuru yazılıysa imzanız; Türk vatandaşıysanız T.C. kimlik numaranız, yabancıysanız uyruğunuz ile pasaport numaranız veya varsa kimlik numaranız; tebligata esas yerleşim yeri veya iş yeri adresiniz; varsa bildirime esas e-posta adresiniz, telefon ve faks numaranız; talebinizin konusu. Talebinizle ilgili bilgi ve belgeleri de başvurunuza eklemeniz gerekir.
Başvurunuz, talebin niteliğine göre en kısa sürede ve en geç otuz gün içinde ücretsiz olarak sonuçlandırılır. İşlemin ayrıca bir maliyet gerektirmesi halinde Kurul tarafından belirlenen tarifedeki ücret alınabilir. Yanıtımız size yazılı olarak veya elektronik ortamda bildirilir.
Kurul'a şikâyet hakkı
Başvurunuzun reddedilmesi, verdiğimiz yanıtı yetersiz bulmanız veya süresi içinde yanıt verilmemesi halinde, yanıtı öğrendiğiniz tarihten itibaren otuz gün ve her halde başvuru tarihinden itibaren altmış gün içinde Kişisel Verileri Koruma Kurulu'na şikâyette bulunabilirsiniz. Şikâyet yoluna gidebilmek için önce bize başvurmuş olmanız gerekir.

What personal data we process
cpmistanbul.com is a portfolio website. There are no accounts, sales or advertising on the site. Personal data is processed in three situations: when you submit the contact form, in the technical logs the server keeps when you connect to the site, and while visit statistics are compiled.

We do not need special categories of personal data (such as health information) to answer your inquiry. Please do not include such information in your message.

Purposes and legal bases
We process your personal data for the purposes below, relying on the legal bases listed in Article 5(2) of the Law. Because each of these activities has a legal basis provided by the Law, we do not rely on your explicit consent.

How personal data is collected
Your personal data is collected electronically and by automated means. What you type into the contact form reaches us when you submit it; transaction security data is recorded by the server each time you connect to the site. To prevent spam, the server keeps your IP address for a short time in working memory only; it is not stored permanently. The server logs do not contain your full IP address, only a shortened form of it. Visit statistics are collected automatically by a script on the site when you open a page; no cookies are used and your IP address is not stored.
Who we share personal data with, and why
We do not sell your personal data or share it with anyone for advertising. In line with Articles 8 and 9 of the Law, it is transferred only to the recipients below and only for the stated purpose:
- Hosting provider: Hetzner Online GmbH (Germany), which operates the server the site runs on. Server logs, visit statistics and form submissions are processed on this server. Hetzner acts as a data processor, on our behalf and on our instructions.
- Email service provider: Form submissions are delivered to info@cpmistanbul.com through our business email service, Google Workspace, and stored there. Google acts as a data processor, on our behalf and on our instructions. The data may be processed in Google's data centres in several countries, including the United States.
- Authorised public bodies: Courts, public prosecutors and other bodies legally entitled to request information; only where legally required and limited to the information requested.
When you play one of the project videos on the home page, the video is loaded from YouTube via youtube-nocookie.com. From that moment Google may process data under its own privacy policy and on its own responsibility; we have no access to that data. See the Privacy and Cookie Policy for details.
International transfers
Because the server hosting our site is located in Germany, your personal data is processed abroad when you connect to the site and when you submit the form. Because our email service provider, Google, is also established outside Türkiye, form submissions are also transferred abroad through this service.
Retention periods
- Contact form submissions: Kept in our mailbox for as long as needed to answer your inquiry and consider a possible collaboration. Correspondence that does not lead to a business relationship is reviewed regularly and deleted once it is no longer needed. If your inquiry becomes a business relationship, the related correspondence is kept for the periods required by the Turkish Commercial Code and tax legislation.
- Submissions that could not be emailed: If the email cannot be sent because of a technical problem, a copy of the submission is kept on the server for at most 30 days so your message is not lost, and is then deleted automatically.
- Visit statistics: Deleted automatically after 2 years.
- Server logs: Deleted automatically after 30 days. They contain only a shortened form of your IP address, not the full address.
- IP data held to prevent spam: In working memory only and for a short time; not stored permanently.
Personal data whose retention period has expired, or whose reason for processing no longer exists, is erased, destroyed or anonymised in accordance with the Regulation on the Erasure, Destruction or Anonymisation of Personal Data.
Your rights under the Law
Under Article 11 of the Law, you may apply to CPMistanbul to:
- find out whether your personal data is processed,
- request information about the processing if it is,
- find out the purpose of the processing and whether your data is used in line with that purpose,
- know the third parties in Türkiye or abroad to whom your data is transferred,
- request correction if your data is incomplete or inaccurate,
- request erasure or destruction of your data under the conditions set out in Article 7 of the Law,
- request that any correction, erasure or destruction be notified to the third parties to whom your data was transferred,
- object to an outcome against you that results from analysis of your data exclusively by automated systems,
- claim compensation if you suffer damage because your data was processed unlawfully.
How to apply
Under the Communiqué on the Procedures and Principles of Application to the Data Controller, you can submit requests about these rights in any of the following ways:
- By a signed written application, delivered in person to Cumhuriyet Mah. Kazım Orbay Cad. C Blok No:3/11, Şişli / İstanbul, or sent by registered mail with return receipt or through a notary,
- By email to info@cpmistanbul.com, signed with a secure electronic signature or mobile signature,
- By email to info@cpmistanbul.com from an email address you have previously given us and that is registered in our systems.
Your application must include: your first and last name and, for written applications, your signature; your Turkish ID number if you are a Turkish citizen, or your nationality and passport number (or ID number, if any) if you are not; your residential or business address for notifications; your email address, phone and fax number for notifications, if any; and the subject of your request. Please also attach any information and documents relevant to your request.
We will conclude your request as soon as possible depending on its nature, and within thirty days at the latest, free of charge. If the action requires an additional cost, a fee may be charged according to the tariff set by the Board. Our response will be sent to you in writing or electronically.
Right to complain to the Board
If your application is rejected, you find our answer insufficient, or we do not answer in time, you may file a complaint with the Personal Data Protection Board within thirty days of learning of our answer, and in any case within sixty days of your application. You must apply to us first before you can file a complaint.
